1. Overview

These Terms of Service govern access to and use of https://trendystuf.store and purchases from TRENDY STUFF. The store is operated by MYROSLAV CHEPAK and uses Shopify's ecommerce platform. By using the website or placing an order, you agree to these Terms and the policies incorporated into them. Nothing in these Terms excludes mandatory consumer rights.

2. Eligibility and acceptable use

You must have legal capacity to enter a contract or use the store with authorization of a parent or guardian. You may not use the store for unlawful, fraudulent, abusive, infringing, or harmful activity; interfere with security or operation; introduce malware; scrape or exploit the service without authorization; or provide false information.

3. Store platform and third-party fulfillment

Shopify hosts the store. Products may be sourced and fulfilled by third-party suppliers. Products in one order may ship from different facilities and arrive separately. References to a supplier or fulfillment location do not create a contract between you and that supplier unless required by law.

4. Product information

We try to describe products accurately, but colors and appearance may vary by screen, lighting, production batch, and reasonable manufacturing tolerances. Dimensions are approximate unless stated otherwise. We may correct errors, update information, limit quantities, discontinue products, or cancel an affected order with a refund where appropriate. Product images, descriptions, and advertising do not override mandatory rights concerning defective or misdescribed goods.

5. Orders and acceptance

Submitting an order is an offer to purchase. An automated acknowledgement does not necessarily mean acceptance. We may verify payment, identity, address, inventory, pricing, fraud risk, and legal or shipping restrictions before accepting or fulfilling an order. We may refuse or cancel an order for legitimate reasons. If payment was captured for a cancelled order, we will refund it as required by law.

You are responsible for accurate billing, shipping, and contact information. Contact support@trendystuf.store promptly to request a correction; changes cannot be guaranteed after fulfillment begins.

6. Prices, payment, taxes, and duties

Prices and currency are displayed at checkout. Payment must be made using an offered method. Payment providers may apply their own terms. We may correct an obvious pricing error before shipment and offer cancellation or purchase at the corrected price where lawful.

Taxes collected at checkout will be shown. International orders may incur duties, import taxes, brokerage, or customs charges unless checkout states they are included. The recipient is responsible for such charges where permitted by law.

7. Shipping and delivery

Shipping is governed by our Shipping Policy: https://trendystuf.store/policies/shipping-policy. Current US estimates are normally 1-5 business days for processing plus 8-14 business days for carrier transit. Estimates are not guarantees and may be affected by suppliers, carriers, customs, weather, holidays, security review, and circumstances outside our reasonable control. Risk and responsibility for goods transfer only as provided by applicable law.

8. Returns, refunds, exchanges, and cancellations

Returns, refunds, exchanges, and cancellations are governed by our Return and Refund Policy: https://trendystuf.store/policies/refund-policy. The voluntary return-request period is 21 calendar days after delivery, subject to mandatory rights and stated lawful exceptions. All returns require prior approval and the correct order-specific return address. Do not send goods to the address on the original package without authorization. Depending on the circumstances, we may provide a replacement, refund without physical return, partial refund by agreement, reshipment, or an authorized return and refund.

9. Customer accounts

You are responsible for protecting account credentials and for activity under your account. Notify us promptly of suspected unauthorized use. We may suspend access where reasonably necessary for security, fraud prevention, legal compliance, or enforcement of these Terms.

10. Promotions and discount codes

Promotions may have additional conditions and may be changed or withdrawn before an order is placed. Codes have no cash value, cannot be combined unless stated, and may be refused where expired, ineligible, transferred unlawfully, or abused. Mandatory consumer rights remain unaffected.

11. Reviews, feedback, and submissions

If you submit reviews, feedback, photos, or other content, you confirm that you have the right to do so and that it is accurate, lawful, and non-infringing. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display the submission for operating and promoting the store, subject to applicable privacy law. We may remove unlawful, abusive, deceptive, or irrelevant content.

12. Intellectual property

Store content, branding, graphics, text, and layout are owned by or licensed to TRENDY STUFF and are protected by applicable law. You may use the website for personal shopping purposes only. No license is granted to copy, reproduce, distribute, exploit, or misuse protected content except as legally permitted.

13. Third-party services and links

The store may use or link to Shopify, payment providers, carriers, social platforms, and other third-party services. Their services and notices govern their independent processing and functionality. We are not responsible for third-party services we do not control, subject to applicable law.

14. Privacy

Our processing of personal information is described in our Privacy Policy: https://trendystuf.store/policies/privacy-policy. By using the store, you acknowledge that notice. Where consent is legally required, it will be requested separately.

15. Service availability and changes

We may maintain, update, suspend, or discontinue parts of the website and correct errors. We do not guarantee uninterrupted or error-free availability. Changes will not remove rights already attached to an accepted order except where permitted by law.

16. Disclaimer and limitation of liability

To the maximum extent permitted by law, the website is provided on an as-available basis. We do not exclude liability that cannot lawfully be excluded, including mandatory liability for defective products, fraud, deliberate misconduct, death or personal injury where applicable, or statutory consumer remedies.

Where limitation is permitted, TRENDY STUFF is not liable for indirect, incidental, special, or consequential loss that was not reasonably foreseeable when the contract was formed. Any permitted limitation will be applied fairly and consistently with applicable consumer law.

17. Your responsibility for misuse

To the extent permitted by law, you are responsible for losses reasonably caused by your unlawful use of the store, infringement of third-party rights, fraudulent activity, or material breach of these Terms. This does not require a consumer to compensate us for losses not caused by that consumer.

18. Severability and no waiver

If a provision is unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions continue in effect. Failure to enforce a provision is not a waiver.

19. Governing law and consumer protections

These Terms are governed by the laws applicable to the Seller in Italy, without depriving consumers of mandatory protections available under the laws of their place of residence. Consumers may bring claims in any forum available under mandatory law. Nothing here requires a consumer to waive rights or use arbitration unless separately and validly agreed.

20. Changes to these Terms

We may update these Terms prospectively by posting a revised version and effective date. The version in effect when an order is accepted normally governs that order unless law requires otherwise.

21. Entire agreement

These Terms, the policies incorporated by reference, product information, checkout disclosures, and order confirmation form the agreement concerning use of the store and purchases, without excluding rights or representations that cannot lawfully be excluded.
